Terms & Conditions and Cancellation Policy

These Terms & Conditions outline the basis of your booking, including payment, cancellation, and your responsibilities during your stay. Please read them carefully before confirming your reservation.

1. Definitions

“We”, “us”, and “our” refer to Properties By Anish LTD.
“Guest” refers to the individual or entity making the booking.

2. Formation of Contract

A booking is confirmed once payment has been received and written confirmation has been issued. By confirming a booking, the guest agrees to these Terms & Conditions.

3. Payments

  • Full payment is required prior to the stay unless otherwise agreed in writing

  • We reserve the right to cancel any booking where payment is not received by the agreed deadline

  • Payments are processed via third-party providers

Authorisation
By providing payment details, the guest authorises us to charge the payment method for:

  • Any outstanding balances

  • Damages or losses

  • Additional services

  • Costs arising from breaches of these Terms

4. Security Deposit

  • A refundable security deposit may be required prior to check-in

  • The deposit is held against damages, breaches of these Terms, or additional costs incurred

  • Any deductions will be reasonably assessed and communicated

5. Rental Agreement Requirement

  • A separate rental agreement may be issued for each booking

  • Where issued, this must be signed prior to check-in

  • Failure to sign the rental agreement may result in cancellation of the booking without refund

  • In the event of any conflict, the rental agreement shall take precedence over these Terms

6. Cancellations & Refunds

Short-Term Stays (Less than 28 Nights)

  • Free cancellation up to 7 days before check-in

  • 50% refund for cancellations made between 7 days and 48 hours before check-in

  • No refund for cancellations made within 48 hours of check-in

Long-Term Stays (28 Nights or More)

  • Free cancellation up to 14 days before check-in

  • If cancelled within 14 days of check-in, the first 14 nights are non-refundable

  • After check-in, a minimum of 14 days’ notice is required to terminate the stay

  • The guest remains liable for payment during the notice period

Non-Refundable Bookings

  • Where a discounted non-refundable rate is selected, no refunds will be issued under any circumstances

Refund Processing

  • Refunds will be processed based on the net amount received by us

  • Any non-recoverable payment processing fees (including but not limited to Stripe or similar providers) will be deducted from the refund

  • By confirming the booking, the guest expressly agrees to this condition

7. Amendments

  • All booking amendments are subject to availability

  • Rate differences may apply

  • We reserve the right to decline amendment requests

8. No Show / Early Departure

  • No refunds will be issued for no-shows or unused nights

9. Guest Responsibilities

The guest agrees to:

  • Use the accommodation lawfully and responsibly

  • Comply with all applicable laws and regulations

  • Take reasonable care of the property and its contents

The guest is responsible for any loss or damage caused during their stay.

10. Liability

  • We shall not be liable for any indirect or consequential loss, including loss of enjoyment, income, or business

  • We are not responsible for loss, theft, or damage to personal belongings

  • Our total liability shall not exceed the total booking value

11. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, or utility failures.

12. Right to Refuse or Terminate

We reserve the right to refuse or terminate a booking without refund where:

  • There is a breach of these Terms & Conditions

  • The guest engages in unlawful or inappropriate behaviour

13. Relocation

In exceptional circumstances, we reserve the right to relocate the guest to comparable or higher-standard accommodation. Where this is not possible, a refund will be issued in line with these Terms.

14. Chargebacks & Payment Disputes

Any chargeback or payment dispute raised without valid grounds will be considered a breach of these Terms.
We reserve the right to recover any associated costs, including administrative, legal, and processing fees.

15. Third-Party Platforms

Where a booking is made via a third-party platform, that platform’s terms may also apply. In the event of a conflict, the platform’s terms will take precedence.

16. Communication

All communication relating to the booking may be conducted via email, phone, or messaging platforms.

17. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Discretion

We reserve the right, at our sole discretion, to offer amendments, credits, or partial refunds outside of these Terms. This does not create any obligation to do so.

20. Agreement

By confirming a booking, the guest acknowledges that they have read, understood, and agreed to these Terms & Conditions.
